1. These Terms and Conditions

  1. These are the terms and conditions on which we supply products to you. Please read these terms carefully before you submit your order to us. These terms tell you who we are, how we will provide products to you, how you and we may end the contract, what to do if there is a problem and other important information.

2. Information about us and how to contact us

  1. The website at michaelbubleperfume.com is owned and operated by or on behalf of Fragrance Dynamics Limited, which is a company registered in England and Wales. Our company registration number is 09072491, our registered office is at Unit 1, The Cam Centre, Wilbury Way, Hitchin, Hertfordshire, England, SG4 0TW, and our trading address is 35 Soho Square, London W1D 3QX. Our registered VAT number is 218975763. We are referred to as “FDL”, “we” or “us” in these terms.

  3. If we have to contact you we will do so by telephone or by writing to you at the email address or postal address you provided to us in your order.

3. Our contract with you

  1. By placing an order with us you agree to and accept these Terms and Conditions. By placing an order via our website you are making an offer to FDL to purchase the products detailed in your order and you agree to accept these Terms and Conditions.
  2. Our acceptance of your order will take place when we email you to accept it, at which point a contract will come into existence between you and us.
  3. If we are unable to accept your order, we will inform you of this by email.This might be because the product is out of stock or because we have identified an error in the price or description of the product.
  4. We will assign an order number to your order and tell you what it is when we accept your order.

4. Our products

  1. We use reasonable care to ensure that the description and specification of our products is correct. However, the images on our website are intended to be for illustrative purposes only and your product may vary slightly from those images.

5. Delivery and title

  1. The costs of delivery will be as displayed to you on our website before you place an order.
  2. We will deliver the products to you as soon as reasonably possible (consistent with the delivery method you choose) and in any event within 30 days after the day on which we accept your order.
  3. If our supply of the products is delayed by an event outside our control then we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. Provided we do this we will not be liable for delays but if there is a risk of substantial delay you may contact us to end the contract and receive a refund for any products you have paid for but not received.
  4. If no one is available at your address to take delivery and the products cannot be posted through your letterbox, the delivery agent or courier will leaveyou a note informing you of how to rearrange delivery.
  5. If you do not re-arrange delivery or collect them from a delivery depot we will contact you for further instructions and may charge you any further delivery costs. If, despite our reasonable efforts, we are unable to contact you or re-arrange delivery or collection, we may end the contract and refund your payment(deducting any additional delivery costs).
  6. Products will be your responsibility from the time we deliver the product to the address you gave us.

6. Your rights to end the contract

  1. Your rights when you end the contract will depend on what you have bought, whether there is anything wrong with it, how we are performing and when you decide to end the contract:
    1. If what you have bought is faulty or misdescribed you may have a legal right to end the contract and get a refund, or to get the product replaced – see section 8; or
    2. If you have just changed your mind about the product, see section 7.You may be able to get a refund if you are within the cooling-off period, but this may be subject to deductions and you will have to pay the costs of return of any goods.

7. If you have changed your mind

  1. For products bought online you have a legal right to change your mind and receive a refund within 14 days after the day you (or someone you nominate) receives the goods. If your order is delivered in separate deliveries over different days, you have until 14 days after the day you (or someone you nominate) receives the last delivery to change your mind.
  2. To end the contract with us because you have changed your mind, you must make a clear statement to us setting out the decision to cancel the contract. You can do this by any means including:
      1. Email. Email us at info@fragrancedynamics.com. Please provide your order number, name, home address, details of the order, your phone number and your email address.
      2. Online. Complete the form at the following link on our website http://www.michaelbubleperfume.com/returns-form.
      3. By post. Print off the form at http://www.michaelbubleperfume.com/files/return-form.pdf and post it to us at the address on the form. Or simply write to us at that address, including details of what you bought, when you ordered or received it and your name and address.
      4. By phone. Phone us on +44 (0) 20 3667 7543

    If you end the contract because you have changed your mind, you must return them, together with their original packaging and wrapping, to us by sending them to:

    within 14 days of telling us you wish to end the contract. You must pay the costs of return.

  3. We will refund you the price you paid for the products including delivery costs, by the method you used for payment. However, we may make deductions from the price, as described below.
  4. We may reduce your refund of the price (excluding delivery costs) to reflect any reduction in the value of the goods, if this has been caused by your handling them in a way which would not be permitted in a shop. In particular, for hygiene reasons we cannot accept returns of products where the outer plastic wrapping of products has been broken. In most cases the reduction will be the full price of the products (ie there will be no refund for mishandled products, including products where the seal is broken).
  5. The maximum refund for delivery costs will be the costs of delivery by the least expensive delivery method we offer. For example, we offer both standard and, for an additional cost, express delivery. If you choose express delivery and then return the products because you have changed your mind, we will only refund what you would have paid for standard delivery.
  6. We will make any refunds due to you as soon as possible after receiving the products from you. Your refund will be made within 14 days from the day on which we receive the product back from you or, if earlier, the day on which you provide us with evidence that you have sent the product back to us. We strongly recommend that you ask the Post Office to stamp and date the “Certificate of Posting” on your Despatch Note when sending items back to us. Please ensure that all items being returned are securely packaged.

7. If there is a problem with the product

  2. We are under a legal duty to supply products that are in conformity with this contract. Nothing in these terms will affect your legal rights.
  3. You are entitled to receive products that are as described and of satisfactory quality. If the products do not comply with these standards, then:
    1. for 30 days from delivery, you can reject the product and get an immediate refund.
    2. for 6 months from delivery, we will either replace the product or, you can reject it and we will give you a refund; you may choose which of these you would like, except that if we cannot supply a replacement, for example because the product is no longer in production, we may choose to give you a refund.
    3. during the period after 6 months from delivery, until the sooner of (i) 6 years after deliveryand (ii) the expiry of the product’s shelf life, you have the same rights as at 8.3(b), except that you must prove that the product was defective when you received it.
  4. If the outer packaging of the products is damaged when you receive it, please request a damage confirmation form from the courier. This damage form is required to submit an eligible refund claim.
  5. To exercise your rights to reject or get a replacement for faulty or misdescribed products, email us at info@fragrancedynamics.com and give the following information: your order number, the courier damage reference number, your order number, name, home address, details of the order, your phone number, your email address, the reason for the return, whether you would like a refund or replacement (see 8.3 above for details on which of these you are entitled to).
  6. If you are entitled to a refund, we will refund you the price you paid for the products, including delivery costs, by the method you used for payment.
  7. You must return faulty or misdescribed products, together with their original packaging and wrapping, to us by sending them to

8. Price and payment

  1. We will take reasonable care to ensure that the prices quoted on our website (which include applicable sales taxes e.g. VAT) are correct. Prices are quoted in pounds sterling.
  2. It is always possible that, despite our best efforts, some of the products on our website may be incorrectly priced. We will normally check prices before accepting your order so that, where the product's correct price at your order date is less than our stated price at your order date, we will charge the lower amount. If the product's correct price at your order date is higher than the price stated to you, we will contact you for your instructions before we accept your order.
  3. We accept payment with most major credit and debit cards including but not limited to Visa, Mastercard, American Express and others handled by WorldPay online secure platform. We will not charge your credit or debit card until we dispatch the products to you. If a payment is rejected we will contact you. We will not despatch the products until we have received payment.
  4. Payment will be taken in UK pounds sterling. If the account from which you choose to pay is denominated in any other currency, we are not responsible for any additional costs you may incur due to unfavourable exchange rates or currency charges that your bank or credit card provider imposes.

9. Our responsibility for loss or damage suffered by you

  1. We only supply the products for domestic and private use. If you use the products for any commercial, business or re-sale purpose we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
  2. If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or our failing to use reasonable care and skill. We are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen, for example, if you discussed it with us during the sales process.
  3. We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our, or our employees’, agents’ or subcontractors’, breach of any duty of care to you; for fraud or fraudulent misrepresentation; for breach of your legal rights in relation to the products including the right to receive products which are as described and of satisfactory quality.

10. How we may use your personal information

  1. We will use the personal information you provide to us:
    1. to supply the products to you;
    2. to process your payment for the products; and
    3. if you agreed to this during the order process, to give you information about similar products that we provide, but you may stop receiving this at any time by contacting us.
  2. We will only give your personal information to third parties where the law either requires or allows us to do so.

11. Other important terms

  1. We may transfer our rights and obligations under these terms to another organisation. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights under the contract.
  2. Nobody else has any rights under this contract. This contract is between you and us. No other person shall have any rights to enforce any of its terms.
  3. If a court finds part of this contract illegal, the rest will continue in force. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
  4. These terms are governed by English law and you can bring legal proceedings in respect of the products in the English courts. If you live in the European Union, but outside England, you can bring legal proceedings in respect of the products in either your local courts or the English courts. If you live elsewhere in the world, you must bring legal proceedings in respect of the products in the English courts.
